Colorful — a coloring book for young children

The short version. Colorful is free. Use it, let your children use it, keep and print what they draw — including commercially, if you like. Do not resell the app or its artwork as artwork. We will keep it working as best we can, but it comes as it is, and a grown-up is responsible for supervising the child using it.

1. This agreement

These Terms of Use are an agreement between you and Utsav Patel (“we”, “us”), the developer of the Colorful app. By downloading or using Colorful you accept them. If you do not accept them, do not use the app.

This agreement is between you and us only, and not with Apple. We, not Apple, are solely responsible for Colorful and its content.

2. Your licence

We give you a personal, non-transferable, non-exclusive licence to use Colorful on any Apple device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Under Family Sharing, the members of your family group may use it too.

You may not sell, rent, sub-licence or redistribute the app; copy or extract its artwork, patterns or sounds for use outside the app; reverse-engineer, decompile or disassemble it except where the law says you may despite this sentence; or remove any notice of ownership from it.

3. What a child makes

The drawings are yours. A picture your child colours in Colorful is theirs to keep, print, frame, publish, sell or hang on the fridge, with no further permission from us and no fee. The uncoloured line artwork remains ours, so please do not repackage the blank pages themselves as a colouring book, a printable, a template pack or a dataset for training a model. Nothing in this section limits what a child may do with a picture they have coloured.

4. Supervision, and what the app is for

Colorful is designed for young children and is meant to be given to a child by a grown-up. It is not a substitute for supervision. There is nothing in it that can reach the open web, no advertising, no in-app purchase, nothing to sign into and no way for a child to be contacted — but a grown-up should still decide when and for how long it is used, and should be the one to operate the share button.

5. What it costs

Colorful is free, contains no advertising, and has nothing to buy inside it. We are not charging you now, and we will not start charging you for something you have already downloaded. If we ever release a paid product, it will be a separate thing you choose.

6. The pages the app downloads

Colorful’s artwork is not built into the app: the first launch fetches it, and it is kept on the device afterwards so the app works offline. We may add, redraw or retire pages over time, and we may change what the app fetches. We try to keep the service available, but we do not promise it will be, and we may change or stop it. An internet connection is needed the first time, and standard data charges from your carrier may apply.

7. Maintenance and support

We are solely responsible for any maintenance and support for Colorful. Apple has no obligation whatsoever to furnish any maintenance or support services. Reach us at utsavhacker@gmail.com — see the support page.

8. Warranty

Colorful is provided “as is” and “as available”, without warranty of any kind, to the fullest extent the law allows. We do not warrant that it will be uninterrupted or error-free.

In the event of any failure of Colorful to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (which for Colorful is nothing) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be our sole responsibility.

Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you, and nothing here removes rights you have as a consumer that cannot be removed by agreement.

9. Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost data, arising out of your use of Colorful. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the app or five US dollars.

Drawings live on the device, so a lost, wiped or replaced device loses them. Save anything precious to Photos.

10. Claims about the app

We, not Apple, are responsible for addressing any claims from you or a third party relating to Colorful or your possession and use of it — including product liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with its use of the HealthKit and HomeKit frameworks, which it does not use.

11. Intellectual property

In the event of any third-party claim that Colorful or your possession and use of it infringes that third party’s intellectual property rights, we — not Apple — are solely responsible for the investigation, defence, settlement and discharge of that claim.

12. Legal compliance

You represent and warrant that you are not located in a country subject to a US Government embargo, or that has been designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.

13. Third-party terms

You must comply with any applicable third-party terms of agreement when using Colorful — for example, your wireless data service agreement.

14. Apple as third-party beneficiary

You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms of Use, and that upon your acceptance of them Apple will have the right — and will be deemed to have accepted the right — to enforce them against you as a third-party beneficiary.

15. Changes to these terms

We may update these terms. The current version always lives at this address, with the date at the top. Continuing to use Colorful after a change means you accept the new version; if you do not, delete the app.

16. Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute — except that this does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring a claim in your local courts where that law gives it to you.
